However, a landlord has the right to enter the property for inspections and repairs as well as for viewing purposes.<\/strong><\/div><div>\u00a0<\/div><div class=\"article-detail-subheader\" style=\"text-align: left;\"><strong><span style=\"color: #ff0000;\">Note: Landlord does not have the right to enter the rented property without consent, even your tenant have defaulted on monthly payments!<\/span><\/strong><\/div><\/div>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-4ec085c elementor-widget elementor-widget-text-editor\" data-id=\"4ec085c\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Due to the lengthy official procedures, the fact is that many Malaysian landlords tend to resort to certain *cough cough* self-help measures to get back what they were rightfully owed. But there are two laws in Malaysia which cover this.<\/p><p>Namely,\u00a0<strong>Section 2 (b) of the Contracts Act 1950 (Rev. 1974)<\/strong>\u00a0as well as\u00a0<strong>Section 7 (2) of the Specific Relief Act 1950<\/strong>. Keep reading to know how these two Acts protect tenant!<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-abfbf2a elementor-widget elementor-widget-spacer\" data-id=\"abfbf2a\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"spacer.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<div class=\"elementor-spacer\">\n\t\t\t<div class=\"elementor-spacer-inner\"><\/div>\n\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-a7dbbbe elementor-widget elementor-widget-text-editor\" data-id=\"a7dbbbe\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<h3><strong><span style=\"color: #008000;\">1)\u00a0<\/span><a href=\"http:\/\/www.agc.gov.my\/agcportal\/uploads\/files\/Publications\/LOM\/EN\/Act%20136.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Section 2 (b) of the Contracts Act 1950 (Rev. 1974)<\/a><\/strong><\/h3><blockquote><p><span style=\"color: #ff0000;\"><i>An agreement enforceable by law is a contract.<\/i><\/span><\/p><\/blockquote>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-021d232 elementor-widget elementor-widget-text-editor\" data-id=\"021d232\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>What this means is that your tenancy agreement isn\u2019t just any ol\u2019 agreement, but\u00a0<span style=\"text-decoration: underline;\">a legitimate binding contract<\/span>\u00a0which both parties must abide by.<\/p><p>If your tenancy agreement\u00a0expressly states\u00a0that the landlord doesn\u2019t have the right to enter the tenant\u2019s house without consent, then you can even take legal action against your landlord if they enter your home unannounced!<\/p><p>But!\u00a0<span style=\"text-decoration: underline;\">This is\u00a0only if\u00a0the tenant did not violate any of the agreement\u2019s terms\u00a0either.<\/span> So if you\u2019re found or suspected to have violated the contract agreement, your landlord may then reserve the right to enter your home and take action against you under a court order.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section href=\"http:\/\/www.agc.gov.my\/agcportal\/uploads\/files\/Publications\/LOM\/EN\/Act%20137.pdf\">Section 7 (2) of the Specific Relief Act 1950<\/a><\/strong><\/h3><blockquote><p><span style=\"color: #ff0000;\"><i>Where a specific immovable property has been let under a tenancy, and that tenancy is determined or has come to an end, but the occupier continues to remain in occupation of the property or part thereof, the person entitled to the possession of the property shall not enforce his right to recover it against the occupier otherwise than by proceedings in the court.<\/i><\/span><\/p><\/blockquote>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-4fa31ba elementor-widget elementor-widget-text-editor\" data-id=\"4fa31ba\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>This law on the other hand, basically states that landlords are not allowed to take any action against their tenant without a court order. Yep, even if the irresponsible tenant fails to pay their monthly rent!<\/p><p>So, thanks to the pro-tenant nature of Malaysia\u2019s legal environment, your landlord isn\u2019t allowed to just step into your home without a court order under any circumstance.<\/p><p>That is, unless they go to the extent of getting an eviction order against you. But trying to evict a tenant in Malaysia isn\u2019t the easiest thing.<\/p><p>It\u2019s a process that takes approximately 7 months and RM10,000! So this is usually the last resort for most people.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section
